Property Division

Property law is the law that in the common law legal system governs the various forms of ownership in real property and in personal property. Property is anything that is owned by a person or entity. Property is divided into two types: "real property", which is any interest in land or real estate and "personal property", which is everything else.

For the most part, states have exclusive jurisdiction over the land within their borders so the laws vary from state to state. Property law governs personal interests in property, such as rights of ownership, requirements in sales and transfers of property, and settlement of claims against property.
